Judge refuses to toss Manafort charges; another judge has yet to rule

Special Counsel Within Bounds, Manafort Going to Trial, Judge Rules

US Judge Refuses to Dismiss Ex-Trump Aide Paul Manafort's Criminal Case

The judge who ruled against former Trump campaign chairman Paul Manafort's motion to dismiss stated in the decision that special counsel Robert Mueller "would have been remiss to ignore such an obvious potential link between the Trump campaign and the Russian government". Separately, a judge in Virginia is weighing a similar request to dismiss a tax- and bank-fraud case against him there.

And Deputy Attorney General Rod Rosenstein was acting within his authority to broadly define the special counsel's authority, she said.

But Berman Jackson concluded for several reasons that Mueller's investigation and prosecution of Manafort is legal - and that the special counsel still can maintain some independence while working within the Department of Justice.

Whether Manafort colluded with Russian government officials as Russia was trying to meddle in the 2016 USA election.

"Manafort was, at one time, not merely 'associated with, ' but the chairman of, the presidential campaign, and his work on behalf of the Russia-backed Ukrainian political party and connections to other Russian figures are matters of public record", she wrote.

The nation in brief

"Frankly, the president has been victimized through all this", Fitton told Fox News, "because evidently there is nothing to justify an investigation of him requiring Justice Department resources and authorities the way it's been misused to date".

Giuliani has taken a combative approach to the investigation since being brought on by the president last month.

Judge Jackson previously dismissed a civil case Manafort filed against Mueller, in which Manafort's attorneys argued that the scope of Mueller's investigation was too broad. Ellis, who has yet to issue an order, has asked to see an unredacted copy of the memo that lays out the special counsel's lines of investigation.

Ellis, a 1987 Reagan appointee, said the special counsel still may well have the authority to bring the charges, adding at one point, "I'm not saying it's illegitimate".

Manafort's lawyers' previous push for dismissal hinged on the argument that because the crimes in question do not directly relate to Mueller's core mandate - investigating whether members of Trump's campaign colluded with Moscow - he was not authorized to charge Manafort with them. But Ellis also suggested that if he ruled in Manafort's favor, the case could simply be returned to the US attorney's office for the Eastern District of Virginia.
