17 States and 7 Cities SueCensus Bureau Over New 2020 Citizenship Question The group, which is lead by NY state, filed the suit on Tuesday in Manhattan federal court.
Calling the decision to return a citizenship question to the 2020 US Census "hasty" and "unconstitutional", Massachusetts Attorney General Maura Healey this week did some addition of her own and filed another lawsuit against President Donald Trump. The complaint filed in federal court in ny asserts the question could result in the undercounting of the country's population, leading to allocations of federal funds that don't fairly compensate areas with large immigrant populations.
In addition, the lawsuit contends that the question violates the Constitution's mandate that the Census count every person in the country, not just citizens.
Today's lawsuit was filed in the U.S. District Court for the Southern District of NY. U.S. Rep. Jerrold Nadler said it was a "brazen attempt by the Trump administration to cheat on the census, to undermine the integrity of the census and to attack states.to steal electoral votes from those states and give them to more congenial states that will vote Republican". "Census Bureau directors appointed by presidents of both political parties have not included a question about citizenship since 1950 - almost seven decades ago - out of concern that it would result in an inaccurate count". Obtaining the cooperation of a suspicious and fearful population would be impossible if the group being counted perceived any possibility of the information being used against them. According to the Census Bureau, there are 132 federal programs, including Medicaid, Child Care Development Grants, the Highway Trust Fund, and other Department of Transportation grants, through which resources are allocated by Census data - totaling $675 billion per year.
Asking such a question, the lawsuit alleges, would depress participation in states with large immigrant populations, undermining the accuracy of the census. The census has not asked all US households about citizenship since 1950.
