SC pulls up banks, telecom companies for creating panic on Aadhaar linking

SC refuses interim stay on linking of Aadhaar to mobiles bank accounts

The Supreme Court issues a notice to the Centre on pleas challenging the linking of bank accounts and mobile numbers with Aadhaar.

A bench of Justices A K Sikri and Ashok Bhushan, while refusing to pass any interim order, tagged all the petitions before another Constitution bench which is slated to begin hearing from November last week petitions on whether Aadhaar violated the right to privacy.

The Supreme Court on Friday asked service providers, including banks and telecom companies, to indicate the last date for customers to link their services to Aadhaar.

In this regards, the centre stated that all subscribers had to link their mobile phone numbers with Aadhaar by February 6 under E-KYC verification.

When the government denied that such messages were being sent, one of the judges, Justice AK Sikri commented: "Initially I didn't want to say because the press is here, but I am also receiving such messages".

"Don't create panic and don't bombard people with text messages", the court said. "For existing account holders, the deadline for Aadhaarbased verification is being extended to March 31 and no coercive action will be taken till then", the Centre's affidavit added.

The government citing an order passed by the Supreme Court, said that in February 2017, the apex court approved that all the SIM cards have to be linked with Aadhaar.

On October 25, the government told the top court that the deadline for linking mandatory linking of Aadhaar to receive benefits of government schemes has been extended till March 31, 2018 for those who do not have the 12-digit unique biometric identification number and were willing to enroll for it.

The Bench also made it clear that the case questioning the validity of Aadhaar is scheduled to be heard in last week of November 2017. The Centre also said on Thursday that showing proof of Aadhaar is mandatory for opening new bank accounts.

The Reserve Bank of India (RBI) had earlier announced that the linking of Aadhaar with bank accounts is mandatory.
