But according to Vanity Fair, de la Huerta has been in communication with the New York Police Department, and detective Nicholas DiGaudio told the publication, "I believe based on my interviews with Paz that from the N.Y.P.D. standpoint we have enough to make an arrest".
The NYPD is investigating a third sexual assault allegation against Harvey Weinstein - this time from an actress who accuses the fallen movie mogul of raping her in 2010, authorities said.
Boyce said detectives found the "Boardwalk Empire" actress' story believable and that two people corroborated portions of her account.
"We immediately contacted the district attorney in NY and we started working the case together".
"We have an actual case here", Boyce said. "We're happy with where the case is right now".
But he said that since Weinstein is in another state and the allegations are years old, investigators have to gather evidence first. She told the publication that Weinstein then started to kiss her, and after she tried to brush him away, he pushed her onto the bed, with his trousers down, and lifted up her skirt.
Weinstein insisted they have drinks inside her apartment and that's where the alleged assault happened, she said.
He faces criminal investigations in New York, Los Angeles and London.
"As this is an active investigation", the statement continues, "we will not be commenting further". She said the second rape occurred in December 2010 after Weinstein showed up at her apartment.
She told CBS that she had been drinking that night and was in no state to agree to having sex.
Since then, dozens of women have come forward to tell similar tales of harassment or assault. Weinstein, 65, has previously denied all allegations of non-consensual sex. Police investigated it as a possible case of forcible touching, a misdemeanor with a two-year time limit for bringing charges under NY law.
Manhattan District Attorney Cy Vance has assigned a senior sex crimes prosecutor to the case, spokeswoman Joan Vollero said.
