E-cigarettes banned where regular cigarettes are banned in NY
Supporters of e-cigarettes said that there isn't sufficient proof the devices, which are legal, are a health threat, and that they could be used by some smokers to end the use of traditional tobacco products.
The New York State Court of Appeals rejected the most recent challenge to New York City's ban earlier this year, finding the inclusion of e-cigs in the law was valid.
The ban takes effect in 30 days.
Andrew Cuomo signed a new law Monday adding electronic cigarettes to the Clean Indoor Air Act - making them illegal anywhere tobacco cigarettes are already barred. As recently as last spring, many adult Americans said they didn't know whether secondhand e-cigarette aerosol poses a risk to children.
The devices, which are also called vaping pens, contain a liquid that produces vapors.
NY has added electronic cigarettes to its indoor smoking ban, making it illegal to use the devices in bars, restaurants and most workplaces. These factors could lead to long-term adverse health effects for e-cigarette users and bystanders. "New York state now can be added to the list of states that are leaders in protecting the health of its residents from the dangers of e-cigarettes". In July, the governor approved legislation banning the use of e-cigarettes on school grounds in ny.
Vaping still will be allowed in any private home, hotel rooms and outdoor dining areas that do not have a roof or ceiling enclosure, among other areas.
