SC agrees to hear review petition on standing during 'Jana Gana Mana' in cinema halls

Supreme Court

"You don't need to play the national anthem in a movie hall to be patriotic.People go to movie halls for undiluted entertainment, but the centre may feel that at each of these venues the national anthem has to be played, it is for the centre to take a call", they said.

The court had directed all movie halls and theatres to play the national anthem before the start of a play, movie or any other programme and said audiences must stand up and pay respect to the national anthem in a bid to instil a sense of committed patriotism and nationalism.

On December 9, 2016, the court exempted disabled persons from this order. "Values are inculcated in a broad social and political culture and patriotism can not be inculcated among people by Supreme Court order making it mandatory for playing National Anthem in cinema halls", he said.

"Should we wear our patriotism on our sleeves?".

A bench of judges of Supreme Court of India headed by Chief Justice Dipak Misra agreed to hear the review petition on national anthem in cinema halls which makes it mandatory for people to stand during the national anthem. Where do we stop this moral policing. You are opening vast field for the court to enforce a number of fundamental duties. Can you say this is disrespect to the national anthem? "In our opinion, it is appropriate that Centre takes a call in this mater, and if necessary, as advised, it may think of issuing a notification or circular or Rules by using its discretion without being influenced by our November 30 order".

Justice Chandrachud said cultural and social values are imbibed from parents and teachers and not what courts enforce through its orders. "This could be brought about by playing the national anthem and people will believe that we are all Indians", he said.

The Supreme Court observed that the government can bring in a regulation or ordinance in this regard on the basis of its stand. Where do we draw a line? Justice Chandrachud said: "People wear shorts and go to cinema". He expressed unhappiness over the government supporting the order which mandates standing up for the National Anthem. Senior counsel Chandra Uday Singh, appearing for a film society seeking recall of the November 30 order, asked then why not play the national anthem on railway platforms as well.
